Terms of Service

These Terms of Service ("Terms") govern your use of the applications, services and website provided by DPB Cloud LLC ("DPB Cloud", "we", "us"). By creating an account or using our services, you agree to these Terms. If you do not agree, do not use the services.

1. Eligibility and Accounts

• You must be at least 13 years old (or the minimum age required in your country) to use the services.
• You are responsible for keeping your account credentials secure and for all activity under your account.
• You must provide a valid email address. One account is for one person; you may not resell or share your account unless your plan explicitly allows it.

2. Acceptable Use

You agree to use the services only for lawful purposes and in compliance with the laws of your country. You must not use the services to:

• Engage in any illegal activity, fraud or infringement of intellectual property rights;
• Send spam or unsolicited bulk messages;
• Distribute malware, attack or scan networks or systems, or carry out denial-of-service attacks;
• Access, distribute or promote child sexual abuse material or any other illegal content;
• Harass, threaten or harm others;
• Interfere with or overload our servers, or attempt to bypass plan or device limits.

We may suspend or terminate accounts that violate these rules, without refund.

3. Subscriptions and Payments

• Paid plans give access to the service for the period and data allowance described at the time of purchase.
• Purchases in our iOS Apps are made through Apple In-App Purchase and are subject to Apple's terms. Auto-renewing subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel them in your Apple Account settings.
• Refunds for In-App Purchases are handled by Apple according to its policies. For purchases made through our website, contact support@dpbcloud.com.
• We may change prices for future periods. Changes will not affect a period you have already paid for.

4. Service Availability

We work to keep the service fast and reliable, but we do not guarantee that it will be uninterrupted, error-free, or available in every country or network. Server locations, speeds and features may change over time.

5. Referral Program

Where offered, referral commissions are credited according to the rules shown in the App. We may adjust or end the program, and may cancel commissions obtained through fraud or abuse.

6. Intellectual Property

The Apps, website, names, logos and content are owned by DPB Cloud LLC or its licensors. Some components are open-source software used under their respective licenses. You may not copy, modify, reverse engineer or redistribute the Apps except as permitted by law or those licenses.

7. Termination

You may stop using the services and delete your account at any time in the App (Profile → Delete Account). We may suspend or terminate your access if you violate these Terms or if required by law.

8. Disclaimer of Warranties

The services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, DPB Cloud LLC will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, profits or revenue. Our total liability for any claim relating to the services is limited to the amount you paid us in the 12 months before the claim.

10. Governing Law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules.

11. Changes to These Terms

We may update these Terms from time to time. The new version will be posted on this page with an updated date. Continuing to use the services after a change means you accept the updated Terms.

本条款适用于您使用 DPB Cloud LLC（“我们”）提供的应用、服务和网站。注册账号或使用服务即表示您同意本条款。

1. 账号

• 您须年满 13 岁（或您所在国家规定的最低年龄）。
• 您需妥善保管账号密码，并对账号下的所有行为负责。
• 一个账号仅供一人使用，除非套餐明确允许，不得转卖或共享。

2. 使用规范

您只能将本服务用于合法用途，并遵守您所在国家的法律。禁止利用本服务：

• 从事任何违法、欺诈或侵犯知识产权的行为；
• 发送垃圾信息；
• 传播恶意软件、攻击或扫描网络系统、发起拒绝服务攻击；
• 访问、传播或宣传儿童性虐待内容或其他违法内容；
• 骚扰、威胁或伤害他人；
• 干扰服务器正常运行，或绕过套餐、设备数量限制。

违反以上规定的账号，我们可以暂停或终止服务且不予退款。

3. 订阅与付款

• 付费套餐按购买时说明的时长和流量提供服务。
• iOS 应用内购买通过 Apple 完成，适用 Apple 的条款。自动续期订阅会自动续费，除非在当前周期结束前至少 24 小时取消；可在 Apple 账号设置中管理或取消。
• 应用内购买的退款由 Apple 按其政策处理；通过官网购买的，请联系 support@dpbcloud.com。
• 我们可能调整以后周期的价格，不影响您已付费的周期。

4. 服务可用性

我们会尽力保持服务稳定快速，但不保证服务不中断、无错误或在所有国家和网络环境下都可用。节点位置、速度和功能可能会调整。

5. 邀请返佣

邀请佣金按应用内显示的规则发放。我们可以调整或停止该活动，并取消通过作弊或滥用获得的佣金。

6. 知识产权

应用、网站、名称、标志和内容归 DPB Cloud LLC 或其授权方所有。部分组件为开源软件，按其各自许可证使用。

7. 终止

您可以随时停止使用并在应用内删除账号（我的 → 永久删除账号）。如您违反本条款或法律要求，我们可以暂停或终止您的使用。

8. 免责声明

本服务按“现状”和“现有”提供，不作任何明示或默示保证。

9. 责任限制

在法律允许的最大范围内，我们不对任何间接、附带、特殊或后果性损失负责。我们对任何索赔的总责任以您在索赔前 12 个月内支付给我们的金额为限。

10. 适用法律

本条款适用美国新墨西哥州法律。

11. 条款变更

我们可能会更新本条款，新版本发布在本页面。变更后继续使用即视为接受新条款。
